Qualifiable Expert Testimony:
| Reconstructing traffic collisions on the scene or in a junk yard by yourself is something that many can do. Testifying in Federal, State and Superior Courts is a different situation. An expert witness is an aid to the trier of fact, the jury. An expert used at trial is not an advocate nor an adversary to the parties at issue. Expert testimony is allowed to aid the jury in understanding those things that are outside of the normal experiences of the normal lay person. In other words, an expert is there to help explain to the jury what transpired in a collision based upon the reconstruction. Qualification depends upon the level of additional specific training that an expert has to speak to the issue at hand. I have given expert testimony in State, Superior and Federal Courts in Georgia, Alabama and Arkansas. Kumho Tire and Daubert decisions regarding the use of experts and the exclusion of VooDoo scientists make it extremely necessary for reconstruction experts to stay current and up to date with the latest in technology. Testimony has included Mapping, Photogrammetry, Crash simulations and animations as well as all aspects of speed and time and distance. |
